The Statutory Environment

As an auxiliary of the U.S. Air Force, Civil Air Patrol (CAP) operates under the regulations governing civil aviation. Specifically, CAP aircraft operations are subject to Title 14 of the Code of Federal Regulations (14 CFR), which governs all civil aircraft in the United States. To enhance operational flexibility, CAP benefits from FAA exemptions under Parts 61 and 91, which allow the organization to reimburse private pilots for certain mission-related expenses. These exemptions ensure that CAP can meet mission requirements while maintaining compliance with FAA safety regulations.

The Organizational Regulatory Environment

CAP flight operations are governed by a set of internal regulations that outline the responsibilities of aircrew, aircraft management, and mission execution. The key document, CAPR 70-1, CAP Flight Management, establishes the framework for managing CAP aircrew and flying programs, detailing pilot qualifications, flight release procedures, and the management of CAP aircraft. It ensures that CAP aircrew operate under strict safety guidelines and adhere to the highest standards of operational excellence.

For missions involving emergency services, CAPR 60-3, CAP Emergency Services Training and Operational Missions, governs the policies and procedures that ensure CAP personnel are properly trained and qualified to execute search and rescue, disaster relief, and other operational missions. The regulation also sets standards for the safe and effective conduct of these missions.

In addition to regulations, CAP has developed several CAP Standards (CAPS) to provide more detailed guidance for specific operations.

  • The CAPS 71-series addresses aircrew training, including approved syllabi, minimum training standards, the conducting of flight clinics and Check Pilot Standardization Courses.

  • The CAPS 73-series provides clarification on operational procedures, with an aim at standardizing aviation activities throughout the entire organization.

For additional training, the CAP eLearning Platform provides courses on risk management, flight release procedures, and other key operational topics. The content included in Absorb helps ensure that CAP members are up-to-date on the latest standards and best practices.

The Physical Environment

The physical environment in which CAP operates presents unique challenges, with weather being a primary factor in many aviation mishaps. CAP pilots are encouraged to remain vigilant and use all available resources to assess weather risks before each flight. Tools available through AviationWeather.gov and other weather-related resources provide CAP pilots with the data they need to make informed flight decisions, especially during cold weather operations or in areas prone to adverse conditions.

By staying informed and adhering to CAP’s safety protocols, pilots can better mitigate the risks associated with variable flying environments.
